Ongoing Service Agreement

Services & Pricing

Mow & Edge 

- Services are rendered at the agreed-upon rate per visit and include mowing and edging only.

- Additional services (such as hedging, pruning, fertilising, weed control, mulching, etc.) can be requested, but must be submitted no less than five business days prior to the scheduled visit.

- Requests made within this period may be deferred to the subsequent service appointment.

Block Time Service

- Services are provided at a fixed price for an allocated block of labour time and
encompass all available offerings (mowing, edging, hedging, pruning,
fertilising, weeding, mulching, etc.). For multiple workers, total labour is
cumulative (e.g. two workers for one hour each equal two hours of service).  

Materials:
- A non-selective general herbicide is included. Should other materials or
products be required, these must be supplied by the customer or arranged
through Mitch’s Mowing. - Material requests must be made at least five business days before the scheduled service.

Scheduling & Conditions
- Standard service frequency is every three weeks unless otherwise specified.

- Work will not be conducted during rain, except at the discretion of Mitch’s Mowing & Lawn Services.

- Customers are responsible for ensuring property access on the day of service, including unlocking gates, securing pets, and removing obstacles.

- All activities comply with relevant health and safety regulations regarding
equipment and chemical usage.

Changes, Cancellations & Rescheduling

- Changes or cancellations must be communicated at least 24 hours before the scheduled service.

- Weather-related cancellations will be rescheduled promptly.

- Services may be suspended or terminated immediately for non-payment, denied access, or
unsafe working conditions.

Payment

- Payment is required upon completion of each service unless otherwise agreed.

- Charges are based on the agreed rate.

- Late payments may incur interest or recovery fees at the provider’s discretion.

Discounts       

- Discount terms are detailed in a separate Discounts Policy document.

- Only one discount is applicable per invoice.

Liability & Insurance

- Mitch’s Mowing holds current public liability insurance.

- The Service Provider is not responsible for pre-existing damage or conditions
(e.g., broken irrigation, hidden obstacles, buried utilities), damage due to
unsafe or obstructed work areas, or losses from events outside reasonable
control (e.g., extreme weather, emergencies, force majeure).

- Customers agree to indemnify Mitch’s Mowing against claims resulting from undisclosed hazardous site conditions.

Termination

- The agreement remains in effect until cancelled by either party with reasonable notice.

- Immediate termination is permitted for breaches such as non-payment or failure to provide access.

- Upon termination, outstanding work ceases and a final invoice is issued.

Governing Law & Disputes

- This agreement is governed by the laws of South Australia.

- Dispute resolution follows a process of discussion, then mediation, followed by legal action only if necessary.

Notices

- All formal notices or changes must be submitted in writing via email or letter
using the provided contact details.

General Provisions

- This document constitutes the entire agreement between Mitch’s Mowing & Lawn Services and the customer.

- Amendments must be agreed upon in writing.

- If any portion of this agreement is deemed invalid, the remainder shall remain enforceable.

- Mitch’s Mowing reserves the right to subcontract or assign services, maintaining quality standards.

- All specified timeframes (five business day requests, 24-hour cancellation, etc.)
are considered essential conditions of this agreement.
